Statement Monitoring: Essential Safety Provisions

EPS provides a "Specialist Maintenance Contractors Statement Monitoring service" that monitors your maintenance contractor's essential safety provisions compliance through our unique software. This Statement Monitoring service requires maintenance contractors to provide a statement certifying that their essential safety provisions inspections, testing and maintenance has been performed to the clients' contracts. This Statement Monitoring service is based on the Development Regulations 2008, Ministers Specification 76, Section I Maintenance Building Code of Australia and ensures your statutory obligations are met when signing the Annual Certificate of Compliance with the Maintenance Procedures for Essential Safety Provisions.

SMC Statement Monitoring StatementCompliance with essential safety provisions legislation is an issue of significant interest to building owners, managers, owners corporations, property purchasers, tenants, building visitors, insurance companies and authorities, and statement monitoring is particularly useful when :

  • A dispute arises relating to the lack of testing and maintenance of essential safety provisions
  • A loss occurs as a result of the failure of essential safety provisions to operate in the event of an emergency;
  • A building owner is served with a notice or determination from an authority for non compliance under essential safety provisions legislation.

EPS statement monitoring service provides a safeguard to minimise the risk exposure presented to building owners (managers) when essential safety provisions have failed in an emergency, causing property damage or injury to a person. Our statement monitoring service requires the Specialist Maintenance Contractors Statement to certify (on specific dates each year), that they have performed all required inspections, tests and remedial maintenance works on their contracted essential safety provisions. The statement monitoring system provides signed statements which help provide legal assurance that the contracted essential safety provisions maintenance works have been successfully completed and allows the building owner, occupier, or agent to sign the annual Certificate of Compliance with Maintenance Procedures for Essential Safety Provisions.

Most jurisdictions require the owner or agent to sign an annual certificate certifying compliance with the legislation. EPS has developed a statement monitoring software program that tracks all essential safety provisions statements required by your contractors, specific to each building. Each maintenance contractors' statement is obtained, or through our statement monitoring, you are advised otherwise, before the building owner is required to sign the Annual Certificate of Compliance with Maintenance Procedures for Essential Safety Provisions.
